Right to Manage (RTM)

Right to Manage (RTM) gives leaseholders the legal right to take control of the management of their building without having to prove fault by the landlord.

 

Through an RTM company, leaseholders can make decisions about services, maintenance, and contracts, ensuring their property is managed more transparently and cost-effectively. It has no impact on the owner of the freehold, or ground rents. However, is often a positive step for leaseholders who want more control or who are unhappy about the current situation.

Are there two or more flats in your block?

Even with two flats, it might be possible, but 'more than two' is an easy starting point.

The RTM process is designed for individual blocks - which might mean on a development with many buildings, each one goes through the RTM process separately.

As long as you don't share services with another building, you're  good to go...

Were the original leases granted for more than 21 years?

This is essential to 'qualify' the leaseholders so check your leases.

If you've all got leases that were originally for longer than 21 years, you're good to go...

​

Is your block more than 50% residential by floor space?

The law was recently changed to allow more mixed use blocks to participate in the RTM process.

As long as more than 50% is residential, you're good to go...

Do you have over 50% of leaseholders keen to support the RTM process?

The process requires more than 50% of qualifying leaseholders to participate. This often takes time.

Check eligibility: make sure your building qualifies for RTM.

Form an RTM company: set up an RTM company with support from at least half the leaseholders.

​​

Notify the freeholder: serve the official claim notice.

​​​​

Take over management: once approved, the RTM company manages the building.
